As a commercial real estate agency, we routinely receive personal information about individuals from sources other than the individual themselves. This is referred to as indirect collection under IPP 3A. We collect personal information indirectly from the following types of sources:
- Referring agents or other real estate agencies (for example, when another agent introduces a buyer, tenant, or party to a transaction);
- Landlords, vendors, or their representatives (for example, when a landlord provides contact details for a current or prospective tenant, or a vendor provides details about a buyer);
- AML/KYC identity verification providers (for example, identity verification services we use to comply with our Anti-Money Laundering and Countering Financing of Terrorism obligations);
- Property data and marketing databases (for example, publicly available property registers, title information, and commercial market data services);
- Industry service providers acting as informal referral partners (for example, valuers, property managers, finance brokers, or other professionals in the commercial property sector who refer clients or share contact details in connection with a transaction); and
- Other third parties in connection with a transaction or our business operations (for example, solicitors, accountants, or other professionals involved in a deal).
Your right to be notified of indirect collection: Where we collect your personal information indirectly, we are required by IPP 3A to take reasonable steps to make you aware of this. By publishing this policy on our website, we provide notice of our indirect collection practices. If you have been referred to us or your information has been provided to us by a third party, this policy serves as that notification. You can also contact us at any time to ask what information we hold about you and where it came from.
3. Why We Collect Personal Information
We collect and use personal information for purposes connected with our commercial real estate agency business, including:
- Marketing, selling, leasing, or managing commercial properties;
- Identifying and introducing buyers, tenants, vendors, and landlords;

10. In-House Complaints and Dispute Resolution Procedure
X Commercial South Auckland has a straightforward process for clients, prospective clients, and customers to raise complaints or disputes about our services.
- Contact our Manager by phone or in writing (addressed to 'The Manager'). Explain who your complaint relates to, the grounds for the complaint, and the outcome you are seeking.
- The Manager may ask you to formalise your complaint in writing. They will investigate with the relevant team member(s) and acknowledge your complaint within 5 working days, including arranging a meeting if appropriate.
- If no agreement is reached, the Manager will provide a written proposal to resolve the matter.
- If you do not accept the written proposal, please advise us within 5 working days and propose an alternative resolution.
- If we accept your proposal, we will confirm in writing and act as quickly as possible. If we decline, we may invite mediation.
- If mediation does not resolve the matter, our in-house process is concluded. You may then register your complaint with the Real Estate Authority (REA).
